1. Introduction

These Terms of Service ("Terms") govern your use of the services provided by NIE Experts Spain ("we," "us," "our"), a brand operated by NBU Advisory LLC, a company registered in the State of Wyoming, United States.

By purchasing any service package or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Services

NIE Experts Spain provides informational consulting services to assist individuals in understanding and navigating the process of obtaining the Número de Identificación de Extranjero (NIE) in Spain.

Our services are structured in three tiers. Each tier includes a specific scope of support as described on our website at the time of purchase. In general terms:

Digital Tier: Automated delivery of step-by-step instructional guides, document checklists, and self-service resources. No direct human interaction is included.

Expert Tier: Everything included in the Digital Tier, plus personalized document review, tailored guidance based on your specific situation, and direct support via messaging to help you prepare your application.

Concierge⁺ Tier: Everything included in the Expert Tier, plus priority one-on-one support, real-time assistance during the preparation phase, and a paid consultation call for complex cases.

The exact scope, deliverables, and pricing for each tier are published on our website and may be updated from time to time.

3. What Our Service Is NOT

This is critically important and must be understood before purchasing:

We do not guarantee the obtainment of a NIE. The NIE is issued solely at the discretion of the Spanish public administration (Policía Nacional / Oficina de Extranjería). We have no control over their decisions, processing times, or appointment availability.

We do not book appointments on your behalf. We provide detailed instructions so you can book your own appointment through the official Spanish public administration systems.

We are not a law firm and do not provide legal advice. Our service is informational and educational in nature. For legal matters, we recommend consulting a qualified attorney licensed in Spain.

We are not affiliated with the Spanish government or any public administration body.

4. Client Responsibilities

By using our services, you agree to:

Provide accurate, complete, and truthful information and documentation.

Follow the instructions and guidance provided in a timely manner.

Book your own appointment using the tools and instructions we provide.

Ensure your documents meet the requirements outlined in our guides before attending your appointment.

Understand that the outcome of your NIE application depends on factors outside our control, including but not limited to: the completeness of your documents, the criteria applied by the specific office, and current Spanish regulations.

5. Payments

All payments are processed securely through Stripe. Prices are displayed on our website in Euros (EUR) and are inclusive of all applicable fees unless otherwise stated.

Payment is required in full before access to services is granted.

By completing a purchase, you authorize us to charge the selected payment method for the total amount of the chosen service tier.

6. Refund Policy

We are confident in the quality and effectiveness of our service. However, we understand that outcomes outside of our control may occasionally occur.

Eligibility for refund: A refund may be requested if, after attending two appointments at the Spanish public administration with the documentation and guidance we provided, the NIE is still not issued. This applies regardless of the tier purchased.

Conditions:

You must have followed our guidance and presented the documents we provided at both appointments.
You must have attended both appointments within a reasonable time frame from the purchase date.
Evidence of both appointments (confirmation, receipts, or rejection notices) may be requested to process the refund.

How to request a refund: Send your refund request to admin@nieexpertsspain.com with:

Your full name and the email used at purchase.
Stripe order ID (received in your confirmation email).
Brief description of the outcome at both appointments.
Any supporting documents.

We will process eligible refund requests within 14 business days from receiving complete information. Refunds are issued to the original payment method.

Non-refundable cases:

The client did not attend the appointments or did not follow our guidance.
The NIE was not issued due to documentation problems or behavior that was not consistent with the instructions provided.
The client purchased the Digital Tier and never used the materials provided.

7. Limitation of Liability

To the maximum extent permitted by law, NBU Advisory LLC and its representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use or inability to use our services.

Our total liability for any claim arising under these Terms is limited to the amount paid by you for the service in question.

8. Intellectual Property

All content provided through our services, including but not limited to guides, checklists, templates, and instructional materials, is the intellectual property of NBU Advisory LLC.

You may not reproduce, distribute, share, resell, or make publicly available any of our materials without prior written consent.

Your purchase grants you a personal, non-transferable, non-exclusive license to use the materials for your own NIE application process.

9. Communication

By purchasing our services, you consent to receive communications from us via email and/or messaging platforms (such as WhatsApp) for the purpose of delivering the service you purchased.

You may opt out of marketing communications at any time, but opting out of service-related communications may limit our ability to provide the service.

10. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms on our website with a new "Last updated" date.

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Any dispute arising from or related to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in the State of Wyoming in accordance with the rules of the American Arbitration Association.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
